1. Agreement
These terms form an agreement between Kaam HR Technologies Pvt. Ltd. (“Kaam HR”) and the organisation that subscribes to the service (“Customer”). By creating an account or using the service, you confirm that you are authorised to accept these terms on the Customer’s behalf. If you have a signed order form with us, it takes precedence where it conflicts with these terms.
2. The service
Kaam HR provides software for attendance, leave, payroll, onboarding, reporting and related HR functions. We may improve or change features over time, but will not materially reduce the core functionality of your plan during a paid term.
Payroll figures are computed from the data and rules you configure. You remain responsible for reviewing payroll before approval and for statutory filings and payments.
3. Accounts and access
- You are responsible for the users you invite and the roles you assign to them.
- Keep credentials confidential and tell us promptly about any unauthorised access.
- You must not share accounts between people or circumvent role-based restrictions.
4. Customer data
You own all data you and your employees put into the service (“Customer Data”). You grant us a limited licence to process it only to provide and secure the service, as described in our privacy policy and Data Processing Agreement.
You are the Data Fiduciary for your employees’ personal data under the DPDP Act, 2023. You are responsible for giving required notices, obtaining consent where needed (including for face verification) and offering an alternative check-in method to employees who decline.
5. Acceptable use
You agree not to:
- Use the service to track people who are not your employees or contractors.
- Use location or face data for any purpose other than attendance verification.
- Upload unlawful content or malware, or attempt to probe or disrupt the service.
- Reverse engineer the service or use it to build a competing product.
6. Fees and billing
Fees are charged per active employee per month at the rates on our pricing page or your order form, exclusive of GST. Monthly plans are billed in advance each month; yearly plans are billed in advance for the year.
Invoices are due within 15 days. If an invoice is more than 30 days overdue, we may suspend access after giving 7 days’ written notice. Your data is not deleted during suspension.
7. Availability and support
We aim for 99.9% monthly availability, excluding scheduled maintenance announced in advance. Enterprise plans include a written service level agreement with service credits. Support is provided by email on all plans, with additional channels as described for your plan.
8. Term and termination
Subscriptions renew automatically for the same period unless cancelled before the renewal date. Either party may terminate for material breach that is not cured within 30 days of written notice.
After termination you can export your data for 30 days. We then delete Customer Data within 90 days, except where we must retain it by law.
9. Warranties and liability
The service is provided with reasonable skill and care. Except as stated in these terms, it is provided “as is”, without other warranties.
Neither party is liable for indirect or consequential losses, or loss of profits. Each party’s total liability under these terms is limited to the fees paid by the Customer in the 12 months before the claim. These limits do not apply to breach of confidentiality, your payment obligations, or liability that cannot be limited by law.
